Introduction

This RadioPublic Privacy Policy (the “Policy”) sets out our privacy practices and explains how your personal data is collected and processed when you use RadioPublic, a service offered by Acast. 

References to “Acast”, “us”, “we” or “our” means the Acast legal entity identified below, as the case may be.  

This Policy is directed to listeners and podcasters (“you” or “your”) that visit, access or use the RadioPublic websites, services, mobile applications, products and content (together, the “RadioPublic Services”).

Data controller details:

If you are a listener located in the EEA, Switzerland or the UK, Acast AB (publ) company reg. no. 556946-8498 located at Kungsgatan 28, 111 35 Stockholm, Sweden is the data controller responsible for the processing of your personal data pursuant to this Policy. 

If you are a listener located outside of the EEA, Switzerland or the UK, Acast Stories Inc., a company with a registered office at 79 Walker Street, New York, NY 10013 is the data controller responsible for the processing of your personal data pursuant to this Policy. 

If you are a podcaster, Acast AB (publ) company reg. no. 556946-8498 located at Kungsgatan 28, 111 35 Stockholm, Sweden is the data controller responsible for the processing of your personal data pursuant to this Policy.

What information we may collect and why we collect it – Listeners

Categories of personal data – When you use RadioPublic Services as a listener, we may collect and process the following categories of personal data:

  • your Internet Protocol (IP) address;
  • your device type (such as device or browser type);
  • your referral information (i.e. a URL link that tracks how you have landed on the RadioPublic website and/or App);
  • your phone number or email (optional); and
  • personal data collected via cookies (if any). 

Purposes of the processing We collect this information in order to: 

  • Generate aggregated, non-identifying data reports about how you use the RadioPublic Services for insights, analytics and diagnostics;
  • Send certain content to your email or phone number (at your request); and
  • Prevent, detect or block fraudulent or disruptive behavior.

Legal basis – The processing of your personal data is based on our legitimate interest. We have performed a balancing test and have concluded that the processing of your data will have minimal impact to your privacy and that it is necessary to continue to provide you with the RadioPublic Services.

Retention period – Your personal data is retained for 30 days after collection. We may retain anonymized data for analysis and information purposes.

What information we may collect and why we collect it – Podcasters

 Categories of personal data – When you use RadioPublic Services as a podcaster, we may collect and process the following categories of personal data:

  • your RadioPublic account information (such as name and email address);
  • your Internet Protocol (IP) address;
  • your device type (such as device or browser type); and
  • personal data collected via cookies (if any).

Purposes of the processing We collect this information in order to: 

  • Give you access to your RadioPublic account and communicate with you;
  • Send you newsletters regarding events, news and offerings that we think you might be interested in;
  • Generate aggregated, non-identifying data reports about how you use the RadioPublic Services for insights, analytics and diagnostics; and
  • Prevent, detect or block fraudulent or disruptive behavior.

Legal basis – The processing of your personal data is necessary for the performance of the contract we have entered with you. In some cases, the processing of your personal data is based on our legitimate interest, for example when we process your IP address for fraud prevention purposes. We have performed a balancing test and have concluded that the processing of your data will have minimal impact to your privacy and that it is necessary to continue to provide you with the RadioPublic Services. Additionally, if you have signed-up for our newsletters, we process your information based on your consent.

Retention period – Your personal data will be retained for as long as your account is not deleted by us upon your request. We may retain anonymized data for analysis and information purposes.

Emails from RadioPublic (podcasters only)

If you have created a RadioPublic account, we may send you from time to time  administrative emails regarding account or service changes, or notify you of updates made to our terms and policies. You cannot opt out of those emails. 

If you have signed-up for our newsletters, you can always opt out from those emails by using the opt-out feature provided in the newsletter. 

We won’t email you to ask for your password or other account information. If you receive such an email, send it to us so we can investigate.

Disclosure of your personal data

In order to provide you with the RadioPublic Services, we may or share or disclose with our third-party service providers that perform certain services on our behalf. Such service providers are only allowed to use your personal data in accordance with our instructions and pursuant to a written contract. They are also required to keep your personal data safe. For example, we share your personal data with the following service providers:

  • AWS who provides us with hosting services.
  • Mailchimp who provides us with an email marketing platform.

We may also share your personal data with other companies within the Acast group (including our subsidiaries) in order to to carry out our daily business operations and  provide you with the RadioPublic Services described in this Policy.  

We will share your personal data with a third-party if we are required to do so by law or if we in good faith believe that such action is necessary to comply with a legal obligation under applicable law or a valid legal process. We will also share your personal data where it is necessary for our legitimate interests or those of a third-party and your interests and fundamental rights do not override those interests. Such legitimate interests may include protecting and defending our rights, or protecting the safety of any person.

Transfers to other countries

Certain service providers who process your personal data on our behalf may be located in a country whose data protection laws do not provide a level of protection equivalent to that of the EU. Where such data transfer occurs, we will make sure that an appropriate data transfer mechanism is put in place to protect your personal data. This includes entering into a contract with the service provider in which the EU Commission’s standard contractual clauses (available at the EU Commission’s website) have been incorporated. 

For transfers of your personal data to other Acast group companies based outside of the EU, we will rely on the data transfer agreement entered between all Acast group companies in which the EU Commission’s standard contractual clauses (available at the EU Commission’s website) have been incorporated.

Information about cookies

We use cookies and similar technologies such as pixels and local storage to understand how you use the RadioPublic Services, help you navigate our websites more efficiently, and more generally to improve your online browsing experience.  

We use the following cookies through the RadioPublic Services:

Strictly Necessary Cookies – We use Stripe for online payment processing which sets a cookie on your browser. This cookie is set for fraud prevention purposes and helps assess the risk associated with an attempted transaction. We respect Do Not Track (“DNT”) settings in browsers. If you use the RadioPublic Services and have DNT enabled, we will not set any tracking cookies in your browser.

Data security

We use encryption (HTTPS/TLS) to protect data transmitted to and from our websites. However, no data transmission over the Internet is 100% secure, so we can’t guarantee security. You use the RadioPublic Services at your own risk, and you’re responsible for taking reasonable measures to secure your RadioPublic account (like using a strong password). 

Your data privacy rights

As an individual subject to applicable privacy laws, including the General Data Protection Regulation 2016/69 (“GDPR”), you have the following rights:

Right of access – You have the right, upon request, to be informed of the personal data we collect about you, a copy of which will be provided free of charge. However, we may charge a reasonable fee to comply with requests for further copies of the same information or when a request is manifestly unfounded or excessive, particularly if it is repetitive.

Right to rectification – You have the right to request that we amend or update your personal data where you have identified that it is inaccurate or incomplete.

Right to erasure – In certain circumstances, you have the right to request that we delete your personal data.

To do this please contact us at privacy@acast.com. Please note that if you delete your RadioPublic account, your account and content may be unrecoverable.

Right to restrict processing – In certain circumstances, you have the right to request that we temporarily or permanently restrict the processing of some or all of your personal data.

Right to data portability – In certain circumstances, you have the right to request a copy of your personal data in an electronically retrievable form and the right to use that data in other services.

Right to object to processing – You have a right to object to the processing of your personal data on grounds relating to your particular situation, and an absolute right to object to the processing of your personal data for direct marketing purposes.

Right to withdraw consent – When we process your personal data based on your consent, you have the right to withdraw your consent at any time. The withdrawal of consent shall however not affect the lawfulness of processing based on your consent before its withdrawal.

Right to lodge a complaint with the Data Supervisory Authority – If you believe your personal data is not being processed in accordance with applicable privacy laws, please contact us directly at privacy@acast.com. You also have the right to lodge a complaint with the relevant data supervisory authority in your jurisdiction.

Additional CCPA Rights 

If you are a resident in the State of California, under the California Consumer Privacy Act of 2018 (“CCPA”) you have the following rights:

Right of Access in a Portable Format – You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable request for such information, we will disclose to you:

  • The personal information we have collected about you;
  • Our business purpose for collecting (or selling, if applicable) that personal information; and
  • If we sold or disclosed your personal information pursuant to this Policy, the personal information categories that each category of recipient may have obtained or purchased, respectively.

The information may be delivered by mail or electronically, and if provided electronically, the information will be delivered in a portable and, to the extent technically feasible, in a readily usable format that allows you to transmit the information to another entity.

Deletion Request Rights – In certain circumstances, You have the right to request that we delete any of your personal information that we requested from you and retained.

Sale of Personal Information – We do not sell your personal information. If we transfer your personal information to another business or third-party in a way that the CCPA would treat as a “sale”, we will make sure that we have implemented appropriate mechanisms to give you the right to opt-out of the sale of your personal information (such as providing a clear, and conspicuous “Do Not Sell My Personal Information” link on our website).

Changes to this Policy

We reserve the right to modify or amend the terms of this Policy at any time. When we make material changes to this Policy, we’ll notify you via a message on our website or via email. Any changes to this Policy will become effective as of the date that appears at the very beginning of this document in the section “Effective Date”. Your continued use of the RadioPublic Services following the posting of changes will be deemed an acceptance of those changes. The most current version of the Policy will always be here and we will archive former versions of the Policy here.
